R. v A.J. [2018]

A.J. was a client of ours who had his domestic assault charges withdrawn at the Toronto Old City Hall courthouse.  He charged with Assault, Assault with a Weapon and Mischief Under $5,000 stemming from a night of drunken debauchery with his partner.  The allegations involved pushing, threatening with a knife and damage to a cell phone.  My client took issue with the allegations and instructed me accordingly.  The crown was offering us a conditional discharge with 12 months’ probation upon a plea to simple assault.  Following successful resolution discussions and a comprehensive plan of rehabilitation, the domestic assault charges were withdrawn.  My client walked away without a finding of guilt (discharge) or a criminal conviction.  No jail.  No criminal record.
