267. Every one who, in committing an assault,
(a) carries, uses or threatens to use a weapon or an imitation thereof, or
(b) causes bodily harm to the complainant,
What is the Punishment for Assault with a Weapon or Causing Bodily Harm?
The maximum penalty for both offences under section 267 is ten years in a penitentiary if the Crown elects to proceed by indictment. If the crown proceeds by way of summary conviction, the maximum penalty is exceeding eighteen months in jail.
